What is Domestic Violence?

Section 8 of the Domestic and Family Violence Protection Act 2012 (QLD) defines what an act of Domestic Violence is and it includes behaviour from one person to another that falls into one or more of the following categories:

1.     Physical or sexual abuse; or

2.     Emotional or psychological abuse; or

3.     Economical abuse; or

4.     Coercive; or

5.     Any other way that controls or dominates the other person and causes them to fear for their safety or wellbeing or that of someone else.

 

What is Associated Domestic Violence?

Associated Domestic Violence is behaviour that is defined as Domestic Violence that is from the Respondent (person doing the Domestic Violence) toward a child of an Aggrieved (person receiving the domestic violence) or a child who usually lives with the Aggrieved, or a relative of the Aggrieved or an associate of the Aggrieved.

The court has the power to restrain a person from this behaviour by making a Domestic Violence Order prohibiting the person from committing Associated Domestic Violence.
